Terms of Service
Last updated October 7, 2026
In short
- We gather public heritage information to help you; it can be wrong or out of date, so confirm with the municipality.
- It isn't legal advice.
- The Patina Record is free. Paid plans and reports are offered only on Developer Record, our separate site for developers and professionals, and renew monthly until you cancel.
1. Who we are
The Patina Record (“we”) is operated by Nicolas Consens in Toronto, Ontario. By using the site or an account you agree to these terms. They also cover Patina Record Pro, our site for developers and planning professionals, which uses the same accounts and data. Contact: hello@thepatinarecord.ca.
2. What the service is, and isn't
We compile heritage status information from municipal registers, municipal notices and open data, and show each record with its source and the date it was current. Sources can be incomplete, late or wrong, and municipal decisions can change status at any time. The information is not legal advice. Before you make a legal, financial, purchase, development or demolition decision, confirm a property's status with the municipality and get professional advice.
3. Sources and licences
Much of the data is provided by municipalities and agencies under their own licences, listed on our sources page. Those licences apply to you as well when you reuse the data: keep the source and attribution with anything you share.
4. Your account
You sign in with a link sent to your email. Keep access to that email secure; you're responsible for activity on your account. An account is for one person unless your plan says otherwise. The Firm plan includes up to four teammates, each with their own account; only add people who work with you, and you're responsible for their use of the service.
5. Fair use
- Don't scrape or bulk-download the site; paid exports exist for that.
- Don't present our information as an official municipal record or as coming from a municipality.
- Don't use the service to harass property owners or anyone else, or for anything unlawful.
- Don't try to get around access limits or interfere with the service.
6. What you create
Research records, notes and links you add remain yours. You let us store and show them to you so the service works; we won't publish them without your permission. Only add photos and material you have the right to use.
If you send a record to the public archive, you give us a non-exclusive, royalty-free licence to publish it on the site, credited as you choose, until you withdraw it. We review records before publishing and may decline or remove any record, for example one that includes personal information about a property's owners or occupants. You can withdraw a published record at any time from its editing page, and deleting your account removes it.
Condition reports and their photos are published only after we review them, credited to “a volunteer”. Items you add to a property's community collection are published only after review, under the licence you choose (CC BY 4.0, CC BY-SA 4.0, CC0, or shown here with permission); you confirm you have the right to share them and that anyone recorded agreed. Tours you publish are yours; you let us show, print and embed them. By sending photos you confirm you took them from public property, they show no people, and you license them under Creative Commons Attribution 4.0 (CC BY 4.0). Corrections you send may be summarized on the property's page. Support pledges show the name you choose; we may remove names that are misleading or abusive.
When you say you're researching a building on the volunteer watchlist, the group name you give is shown publicly with it. Use a real group or leave it blank; we may remove claims or names that are misleading or abusive. Each volunteer can hold up to 50 buildings at a time.
7. Paid plans (Developer Record only)
The Patina Record's map, alerts and tools are free. These terms apply to the paid plans and reports offered on Developer Record.
- Paid plans are billed monthly in advance, in Canadian dollars plus applicable taxes, through Stripe.
- They renew automatically each month until you cancel. You can cancel any time from your account; you keep access until the end of the period you've paid for.
- We don't refund partial months, except where the law requires it.
- We'll give at least 30 days' notice by email before a price change applies to you.
- Property reports (the status and due-diligence report and the full history report) are one-time purchases for one property. Each report page lists what each version contains before you buy, and you can reopen it from your account at any time; it is rebuilt from the latest records each time you open it. A status report can be upgraded to the full report for the difference shown. Each purchase includes email alerts about changes to that property for 12 months. If a report is materially different from that list, email us within 30 days for a refund.
8. Exports
Exported data is for your own use and your clients' work, as long as you keep each record's source, licence and attribution. Don't resell or republish the exported dataset as a competing product or service.
9. No warranty
The service is provided “as is”. To the extent the law allows, we make no promises that it will be accurate, complete, current or always available.
10. Limits on our liability
To the extent the law allows, we aren't liable for indirect or consequential losses, or for decisions made using the information, and our total liability for any claim is limited to the amount you paid us in the 12 months before it arose (or $100 if you haven't paid us). Nothing here limits rights you have under consumer protection law that can't be limited.
11. Ending
You can stop using the service and delete your account at any time. We may suspend or close accounts that break these terms, and we may change or discontinue features; if we discontinue a paid feature, we'll refund any prepaid period you can't use.
12. Law
These terms are governed by the laws of Ontario and of Canada that apply there.
13. Changes
We may update these terms. We'll change the date above and, for significant changes, email account holders before they take effect. Continuing to use the service after that means you accept the new terms.
